    Supreme Court on Mullaperiyar

    Hon'ble Supreme Court has given its verdict on the point of water level in the Mullaperiyar dam. It has dismissed the demand of Kerala to bring down the water level to 120 ft. Also the Tamilnadu's demand for raising the water level above 136 ft.stands dismissed. Based on the High level Committee's report, the Apex Court does not consider the damage of the dam as so critical.Hence do not agree with reducing the water level.
    Kerala is now to request the High Level Committee to study the present situation and modify its stand.

    The Supreme court ordered that the water level of Mullaperiayr dam should maintain as 136 feet. So that Kerala government withdrawn the plea for reduce the water level to 120 feet. As the court said, the safety is not to be compromised, but the situation of Mullaperiyar is not so critical. Anyways the next step should be taken by the High Level Committee. Kerala government will request the High Level Committee to study about the present situation of the Mullaperiyar dam. If the High Level Committee will not consider the safety concerns of Kerala, then what will be the destiny of Mullaperiyar and the nearby people? Anyways Minister P.J. Joseph said that if High Level Committee's decision is not favorable to Kerala, then the next action will be after further discussions and decisions.

    The supreme court order is like entering into a tranquil area after being in a place where shout and counter shout contest were going on. Let us hope at least now both side will stop playing to the galary. The court has not out rightly rejected the demand of Kerala for lowering the level to 120 feet. The court has mentioned that his demand of the Kerala will be referred to the 'Empowered Committee' to consider this aspect also while giving their report to court.

    The Empowered Committee was created by the Central Water Commission on the directive of the Supreme Court order of 18.2.10. The court had suggested to the committee to see the representations from both sides on whatever both sides want to present and then consider the points referred and arrive the conclusion. Kerala Should make its case strongly with supporting documents to the committee and try to impress them instead of playing into the hands of the opposite side.

    Kerala should take advantage of the situation and prepare a case in coordination with the vies of the opposition. They should take up the issue of the legality of the 999 years lease of the British Government between the Travancore Raja and the then Madras State. Those parties no longer exist. The agreement is an imposition. Kerala should find out whether there is any need for any quantity of water to its reasonable and justifiable necessities from the Mullaperiyar reservoir. If any need is found place a claim for the quantity water reasonably required for its use as the river and place belong to it. The should undertake a guarantee to supply water with a minimum quantity to Tamilnadu. The Dam and the land should be in its control. All other benefits except the agreed quantity of water to Tamilnadu, Kerala should have the right for its own use or purpose.
